Legacy Immigration Programs

At ICS & Partners, we advise entrepreneurs, investors, business owners, senior professionals and their families on the immigration implications of legacy visa programmes. Our services include reviewing existing immigration permissions, assessing eligibility for Indefinite Leave to Remain (ILR), advising on Home Office compliance and developing alternative immigration strategies where a former route is no longer available.

Many clients arrive in the UK under visa routes that have since been closed or amended. Whether you entered on a Tier 1 Entrepreneur, Investor, or a previous Skilled Worker scheme, understanding the current status of your permission and the steps required to secure long‑term residency is essential.

Although several UK immigration programmes have closed to new applicants, individuals and families who previously obtained permission under these routes may still have immigration rights, settlement opportunities or outstanding applications requiring specialist legal advice.

What a “legacy” visa means

A legacy immigration programme refers to a visa category that was available at the time of entry but has since been withdrawn or replaced. Holders can usually remain in the UK, but their ability to extend, switch, or apply for Indefinite Leave to Remain (ILR) may be limited by the original terms of the route.

Key point: The Home Office does not automatically convert legacy visas into newer categories; proactive assessment is required.

Common legacy routes and their typical challenges

Tier 1 Entrepreneur (closed 2019)

  • Extension only possible if the business continues to meet the original investment threshold.
  • Switching to a Skilled Worker or Innovator route may require a new business plan and fresh investment.
  • ILR eligibility generally requires five years of continuous residence, but the clock may be paused if the original conditions are no longer met.

Tier 1 Investor (closed 2022)

  • Remaining funds must stay in a qualifying UK‑based investment for the required period (usually 2–5 years).
  • Switching to a Innovator or Global Talent route may be viable if you meet the new criteria.
  • ILR can be accelerated to three years if £10 million is maintained, but legacy permissions must still satisfy the original investment conditions.

Key deadlines for legacy immigration programmes

The following table provides an overview of the principal closure dates and settlement deadlines relevant to former Tier 1 visa holders.

Immigration programme

Final extension deadline

Final ILR deadline

Tier 1 (Entrepreneur) – standard route

5 April 2023

5 April 2025

Tier 1 (Entrepreneur) – qualifying former Graduate Entrepreneur or Start-up migrants

5 July 2025

5 July 2027

Tier 1 (Investor)

16 February 2026

16 February 2028

Dates shown are the final days before the statutory cut-offs. The dates relate to principal applicants and are subject to the applicable Immigration Rules, individual immigration history and any relevant transitional provisions.

Important: As of October 2026, all ordinary extension deadlines in the table have passed. The principal remaining settlement deadlines are 5 July 2027 for eligible former Graduate Entrepreneur/Start-up migrants under Tier 1 (Entrepreneur), and 16 February 2028 for Tier 1 (Investor) migrants.

Exceptional circumstances involving successful administrative reviews, appeals or judicial reviews may require separate consideration.

How we assess your situation

Our structured review covers four core areas:

  1. Current permission audit – confirming the exact visa category, expiry dates, and any post‑grant conditions.
  2. Eligibility for ILR – calculating qualifying residence, required absences, and meeting the “continuous residence” test.
  3. Compliance check – ensuring you have met reporting, investment, and employment obligations to avoid breach notices.
  4. Strategic pathway planning – identifying the most suitable modern route (e.g., Innovator, Skilled Worker, Global Talent) and preparing the necessary documentation.

Why a professional review matters

A missed reporting deadline or an investment that falls below the required threshold can trigger a curtailment notice, jeopardising future settlement prospects. Our proactive approach helps you stay compliant and positioned for a smooth transition to ILR or an alternative visa.

What happens when a legacy immigration route has closed?

Closure of an immigration route does not necessarily mean that an individual must leave the UK. The available options depend on their current immigration permission, residence history, family circumstances and the Immigration Rules.

Where an individual cannot extend or settle under a legacy programme, ICS & Partners can assess alternative immigration options, including:

  • Innovator Founder visa: For entrepreneurs proposing qualifying innovative, viable and scalable businesses with the required endorsement.

  • Skilled Worker visa: Where an individual has an eligible employment opportunity with a licensed UK sponsor.

  • Global Talent visa: For eligible leaders and potential leaders in qualifying fields.

  • Family immigration routes: Where the individual qualifies through a partner, child or other applicable family provision.

  • Long Residence: Where the applicant satisfies the applicable lawful residence and other settlement requirements.

  • Human rights and private life applications: Where supported by the individual's particular circumstances and applicable legal tests.

Switching between routes can affect the qualifying residence period for settlement. An application should therefore be considered against both immediate immigration needs and longer-term settlement objectives.
