Settlement (ILR)

Settlement generally allows individuals to live, work and study in the UK without being subject to a time limit on their immigration permission. It can also provide a pathway towards British citizenship, subject to meeting the relevant nationality requirements.

Obtaining Indefinite Leave to Remain (ILR), commonly referred to as UK settlement, represents an important milestone for individuals and families seeking to establish their long-term future in the United Kingdom.

Indefinite Leave to Remain (ILR) is the route that allows you to stay in the United Kingdom permanently without any immigration restrictions. Understanding the eligibility criteria, required documentation and the steps involved will help you prepare a strong application.

Our services extend beyond the preparation of an immigration application. We assess your immigration history, identify potential legal and evidential issues, consider your long-term objectives and develop an appropriate strategy to support your settlement application.

Whether you are approaching the end of your qualifying residence period, managing complex immigration circumstances or planning ahead for British citizenship, our team can assist you at each stage.

Understanding ILR

Indefinite Leave to Remain is an immigration status granted to eligible individuals who meet the settlement requirements under the UK Immigration Rules. Unlike limited permission to remain, ILR does not normally require the individual to renew their immigration permission periodically. Individuals granted ILR can generally:

  • Live permanently in the United Kingdom, subject to the rules governing the loss or revocation of settlement.

  • Work for an employer, establish a business or undertake self-employment without employment sponsorship.

  • Study or undertake professional training without immigration restrictions.

  • Access public services and benefits where they meet the applicable eligibility requirements.

  • Travel outside the UK and return, subject to the rules governing extended absences and the validity of their status.

  • Apply for British citizenship when they meet the relevant statutory requirements.

An important consideration: ILR is not the same as British citizenship. Settlement may lapse following prolonged absence from the UK, and it may be revoked in certain circumstances. Our team helps clients understand both the benefits and continuing obligations associated with their immigration status.

Who can apply for ILR?

Common routes to settlement

  • Spouse or partner of a British citizen or settled person.
  • Skilled worker on a Tier 2/Skilled Worker visa.
  • Long‑term resident (5 years on a qualifying visa).
  • Graduate who has spent 5 years in the UK after completing a degree.
  • Refugee or person granted humanitarian protection.

Key eligibility factors

  • Continuous residence in the UK for the required period (usually 5 years).
  • Meeting the lawful residence test – no serious breaches of immigration law.
  • Passing the Life in the UK Test.
  • Demonstrating adequate knowledge of English (or an approved exemption).
  • Financial stability – you must be able to support yourself without recourse to public funds.
Important: Absences from the UK of more than 180 days in any 12‑month period may reset the qualifying residence period.

Requirements for ILR

While individual requirements differ between immigration categories, settlement applications commonly involve several important legal and evidential considerations.

Continuous residence and absences

Applicants must demonstrate that they have completed the applicable qualifying period in accordance with the relevant Immigration Rules. For many routes, the continuous residence requirement generally restricts absences to no more than 180 days in any rolling twelve-month period, subject to exemptions and transitional provisions.

ICS & Partners can review travel histories, passport records, immigration permissions and Home Office records to establish whether the relevant residence requirements have been met.

Immigration compliance and suitability

The Home Office may consider an applicant's immigration history, previous breaches, criminal convictions, deception findings and other matters relevant to suitability.

Where concerns arise, we can assess the relevant legal provisions and prepare supporting representations addressing the circumstances.

English language and Life in the UK

Many adult applicants must satisfy the applicable English language requirement and pass the Life in the UK Test, unless an exemption applies.

Requirements and exemptions vary according to the applicant's age, circumstances and immigration category. Applicants should verify the standard applying to their intended application date.

Employment, financial and business requirements

Certain settlement routes require additional evidence, such as continued employment, salary, financial support, qualifying investments or business performance.

We work with clients, employers and appointed professional advisers to identify and prepare the necessary supporting evidence.

The ILR application process

1. Prepare your documents

Gather passports, biometric residence permits, proof of continuous residence (e.g., tenancy agreements, utility bills), employment letters, payslips, and any immigration correspondence.

2. Complete the online form

The application is submitted through the UK Visas and Immigration (UKVI) portal. You will need to upload scanned copies of all supporting documents and pay the applicable fee.

3. Biometric appointment

After submitting the form, you will be asked to book a biometric enrolment appointment to provide fingerprints and a photograph.

4. Decision and receipt

UKVI will review your case and may request further information. Once approved, you will receive a digital ILR status and a Biometric Residence Permit (BRP) confirming your settlement.

Typical processing time

Most straightforward ILR applications are decided within 8 weeks, though complex cases may take longer.

Complex ILR applications and immigration history

Not every settlement application is straightforward. Applicants may have experienced changes in immigration categories, periods of overstaying, excessive absences, previous Home Office refusals or other circumstances affecting their eligibility. ICS & Partners provides detailed advice and legal representation where additional legal analysis or supporting evidence may be required.

Our work includes the following:

  • Overstaying and gaps in permission: Reviewing periods without immigration permission, the effect of section 3C leave and applicable exceptions under the Immigration Rules.

  • Excessive absences: Assessing travel records, permitted exceptions and evidence explaining exceptional circumstances.

  • Previous refusals: Reviewing the reasons for previous immigration refusals and determining whether they affect settlement eligibility.

  • Complex family circumstances: Advising where relationships have changed, dependants have different immigration histories or children require separate settlement applications.

  • Criminal convictions and suitability concerns: Assessing the impact of criminal history and other conduct under the applicable suitability requirements.

  • Home Office errors: Identifying potential factual or legal errors and considering available administrative review, appeal or judicial review remedies where appropriate.

Our objective is to identify potential issues before submission and provide clients with a clear assessment of their options, legal requirements and available remedies.

Proposed changes to UK settlement rules

The UK Government has consulted on significant reforms to settlement, including an earned settlement model under which eligibility could depend more heavily on factors such as contribution, conduct and integration.

The November 2025 consultation proposed changes to the established settlement framework, including a longer baseline qualifying period for certain migrants. However, consultation proposals should not be treated as automatically applicable Immigration Rules. Their implementation, scope and transitional protections must be assessed against the rules actually in force.

At ICS & Partners, we help individuals and employers understand the potential implications of immigration policy developments, assess upcoming eligibility dates and plan ahead where changes could affect their long-term immigration position.
